Expunging a Missouri Drug Paraphernalia Charge
A paraphernalia conviction looks minor next to the charges around it, which is exactly why people leave it on their record for years without realising a background check still shows it as a drug offense.
- Statute
- § 579.074
- How it is graded
- Usually a Class D misdemeanor, rising for repeat offenses or where the item relates to manufacturing
How expungement works for this charge
Paraphernalia is one of the two offense types the automatic expungement law reaches, alongside possession, so from no later than January 1, 2027 many of these will clear without a petition. As a misdemeanor it carries the 1-year waiting period and counts against the 3-misdemeanor cap. The practical trap is that paraphernalia rarely appears alone: it is usually charged alongside possession, and the pair has to be looked at together, because the felony and misdemeanor caps are counted separately and the order you file in can matter.
Often eligible
- Misdemeanor paraphernalia after the 1-year waiting period
- Paraphernalia charges dismissed or never filed
- Many cases covered by the automatic process from 2027
- Paraphernalia charged alongside an expungeable possession count
What disqualifies a case
- Paraphernalia counts tied to a manufacturing or distribution charge
- Unpaid fines or court costs on the case
- A pending charge anywhere in Missouri
There are exceptions in both directions and the law changes. Don’t rule yourself out on a list. Let us check the actual record.
The rules that apply to every Missouri expungement
- Waiting periods. Three years for a felony, one year for a misdemeanor or ordinance violation, measured from the day you complete the entire disposition, including probation, parole, fines and restitution.
- Lifetime limits. Up to two felonies and three misdemeanors or ordinance violations that carry possible jail time. Infractions are unlimited and don’t count against either cap.
- It is never automatic. Even when you qualify on paper, the court must also find that you have no pending charges, that all obligations are satisfied, that you are not a threat to public safety, and that expungement serves the interests of justice. The burden is on you, which is what the petition is for.
Different rules apply to first-time alcohol-related driving offenses, which run under § 610.130 with a ten-year wait, once per lifetime.
Questions about drug paraphernalia expungement
Is a paraphernalia charge worth expunging?
Usually yes. It reads as a drug offense on a background check regardless of how minor the underlying facts were, and employers and licensing boards do not see the distinction.
Does paraphernalia count against my lifetime limit?
If it was a misdemeanor, it counts against the 3-misdemeanor cap. Infractions do not count at all. Which one you have is worth confirming before filing.
