Expunging a Missouri Drug Possession Charge
Drug possession is the single most common record we are asked to clear, and it is the one category Missouri has decided to start clearing on its own. That makes the timing question unusually important.
- Statute
- § 579.015
- How it is graded
- Usually a Class D felony, with some first-time and small-quantity cases charged as a Class A misdemeanor
How expungement works for this charge
Possession is worth treating separately from every other charge because of § 610.141, the automatic expungement law. From no later than January 1, 2027, the Highway Patrol begins clearing eligible drug-possession and paraphernalia convictions automatically, on a rolling weekly basis, with the same waiting periods and lifetime caps that apply to a petition. Two things stop that from being the whole answer. The automatic process reaches electronic records only, not paper court files, and it is narrow: possession and paraphernalia, nothing else. If you have any other charge on your record, or you need the record clear before 2027 for a job or a licence, filing a petition under § 610.140 is still the faster and more complete route.
Often eligible
- Felony possession after the 3-year waiting period
- Misdemeanor possession after 1 year
- Possession charges dismissed or never filed after an arrest
- Many older cases now covered by the automatic process from 2027
What disqualifies a case
- Possession with intent to distribute, which is a different offense
- Trafficking charges
- A pending charge anywhere in Missouri
- A new conviction during the waiting period
There are exceptions in both directions and the law changes. Don’t rule yourself out on a list. Let us check the actual record.
The rules that apply to every Missouri expungement
- Waiting periods. Three years for a felony, one year for a misdemeanor or ordinance violation, measured from the day you complete the entire disposition, including probation, parole, fines and restitution.
- Lifetime limits. Up to two felonies and three misdemeanors or ordinance violations that carry possible jail time. Infractions are unlimited and don’t count against either cap.
- It is never automatic. Even when you qualify on paper, the court must also find that you have no pending charges, that all obligations are satisfied, that you are not a threat to public safety, and that expungement serves the interests of justice. The burden is on you, which is what the petition is for.
Different rules apply to first-time alcohol-related driving offenses, which run under § 610.130 with a ten-year wait, once per lifetime.
Questions about possession of a controlled substance expungement
Will my drug possession charge clear automatically?
Possibly, from no later than January 1, 2027, under § 610.141. It covers drug possession and paraphernalia only, applies the same waiting periods and caps, and reaches electronic records rather than paper court files. Anything else on your record still needs a petition.
Should I wait for automatic expungement instead of filing?
Only if possession is the sole thing on your record and you do not need it clear before 2027. Filing under § 610.140 is faster, covers paper records too, and gives you a court order you can point to.
Is felony possession expungeable?
Generally yes. Most possession charges are Class D felonies, which fall inside the expungeable classes, subject to the 3-year wait and the 2-felony lifetime cap.
